TERMS AND CONDITIONS OF USE
By using and visiting the Club Soda website (hereinafter referred to as the Website), the user agrees to follow and comply with the Terms of Purchase and all applicable laws and regulations. The user will no longer be able to use the Website if the Conditions of Purchase are not adhered to; these conditions are subject to change at any time without notice.
By purchasing a ticket from Club Soda, the user agrees that Club Soda will not issue any refunds or exchanges. Club Soda cannot be held responsible for lost, stolen or damaged tickets.
Authorized Use of the Website
The user is authorized to visit the Website to purchase tickets for personal use only. Reproduction or alteration of tickets is prohibited. Unauthorized use of the Website may result in legal action (see Violation of Conditions).
Currency
All prices listed on the Website are in Canadian currency.
Taxes and service charges
Taxes and service charges are included in ticket prices. Service charges vary according to the method of purchase.
Price accuracy
Our team makes every effort to ensure that the information provided on the Website is accurate. However, in the event of any discrepancy between the information displayed on the Website and that provided by our ticket office, the latter shall take precedence.
Payment methods
The Club Soda ticket counter accepts cash, Visa, MasterCard, American Express, and direct payment (Interac). Visa, MasterCard, and American Express credit cards are accepted for online purchases via the Website.
Order confirmation
A confirmation number will be emailed to you once the payment information has been submitted on the Website. Users who receive an error message or experience a service interruption after submitting their payment information should contact Club Soda at 514-286-1010, Ext. 200, during normal business hours. Users may also choose to send an email to info@clubsoda.ca with the date and time of the performance, their name and telephone number, and a member of our team will contact them as soon as possible.
Refund policy
Users must carefully check their choice of event, date, and time of performance before purchasing a ticket. Club Soda does not issue exchanges or refunds except in the following exceptional situations:
- Event cancellation: refund at point of purchase, on the card used for purchase. See details below.
- Postponement of a show: the user may decide to keep the ticket, which will be honoured on the new date. If the new date is not convenient, the user can request a refund by going to the point of purchase with the card used for purchase. If the tickets were purchased by telephone or on the Website, an email will be sent to the user informing them of the procedure to follow.
- Refund of tickets purchased directly at Club Soda: the user must go to the ticket counter during business hours, and the tickets will be refunded by the same method of payment used to purchase them. Where applicable, the user must have on hand the card used at the time of purchase.
- Refund of tickets purchased online or by phone; the user will receive an email with all the details within a few days of the announcement of the change or cancellation of the event. - Refund of tickets purchased directly from the producer: users must refer to the institution or person from which they purchased their tickets. Refunds are made in accordance with the producer's refund policy.
Please contact the organization that sold you the tickets if you have any concerns or questions. In the event of cancellation or postponement, Club Soda will refund the ticket price and service charges, but will not refund delivery charges.
Delivery policy
Electronic tickets: users will receive their tickets by email within minutes of purchase confirmation. They can be printed out, or viewed on their mobile device.
At the ticket counter: when picking up tickets, the user must present the credit card used for purchase, photo ID, and the transaction number.
By mail: users can choose to have their tickets delivered by regular mail. If you have any questions about ticket delivery, or if you have not received your tickets, please call 514-286-1010, Ext. 200, during business hours, or send an email to info@clubsoda.ca. The delivery address must be the same as the billing address associated with the credit card used to make the purchase. Additional delivery fees may apply.
Violation of conditions
Failure to comply with applicable regulations may result in cancellation of tickets without notice. In addition, the use of the Website and the purchase of tickets from Club Soda may be prohibited. Club Soda reserves the right to use all means at its disposal to protect itself against violations of these conditions.
Unauthorized use of the Website
Unauthorized use of the Website for purposes such as ticket distribution and reproduction, as well as unauthorized use of automated devices, may lead to investigation and criminal prosecution. Furthermore, the user agrees not to intentionally interfere with the operation of the Website or copy its content.
Disclaimer notice
Club Soda does not guarantee that the Website will be error-free or without interruption. The Website does not guarantee ticket availability. When a venue reaches capacity, ticket sales are discontinued.
Limitation of liability
Club Soda shall not be liable for damages such as loss of profits, revenue or business opportunities despite notice of such damages. If the user is unable to attend the event, there will be no refund.
Compensation
The user agrees to indemnify Club Soda, its affiliates, partners and employees against damages caused by unauthorized use of the Website. The user accepts that they may be held liable for non-compliance with these terms and conditions.
Privacy policy
Club Soda is committed to protecting the privacy of the users of the Website. Club Soda's commitment is limited to the information it obtains during communications with users. Club Soda cannot make this commitment for other websites that may be in communication with lepointdevente.com and its sub-domains. The user undertakes to read this document carefully. The use of the Website confirms the user's agreement with this policy.
Information
In operating the Website, Club Soda requests “contact information” (last name, first name, mailing address, telephone number and email address), “demographic information” (postal code, city) and “financial information” (password, credit and debit card numbers).
In order to identify and collect general demographic information about users, Club Soda utilizes the user's IP address. When you visit the Website, Club Soda automatically collects your IP address and the address of the last web page you visited.
Club Soda uses cookies to personalize the user's system while saving personal information if the user so chooses. Cookies can be deactivated using the “Help” command in the user's Internet browser, but doing so may render most of the website inaccessible.
Security measures
Club Soda has implemented security measures on its website to protect against the loss, misuse and alteration of information collected. A secure encryption protocol (SSL) is used to protect commercial transactions. The user's personal and financial information is encrypted before it is transmitted over the Internet or stored on our servers. User information may be transferred and stored, in whole or in part, on computer networks located outside the user's province of residence. Information may be stored on computer equipment rented or authorized by third parties.
Use of personal and financial information
Sharing with event suppliers
Club Soda sells tickets on its own behalf. Producers, artists' agents, teams, leagues and the like (hereinafter, the “Event Providers”) produce and present events. The user consents to Club Soda providing this information to the Event Providers involved, if requested. This allows them to communicate with the user via email. In some cases, Club Soda may share contact information or partial financial details with service providers to facilitate ticket pick-up on the night of an event, resolve a dispute or in other exceptional circumstances.
Since event suppliers are not always part of Club Soda, they are not subject to this privacy policy. If the user wishes to learn more about the privacy policies of a particular event provider, they should contact the event provider directly. In addition, it is always possible to purchase tickets anonymously (i.e. without revealing contact or demographic information) by visiting and paying at the Club Soda ticket counter during business hours.
Sharing with financial institutions
Club Soda collects the user's financial information in order to verify the user's ability to pay for the requested services. Club Soda may provide contact information and financial data to credit card issuers, financial institutions or credit card processing companies for their own purposes.
Sharing in exceptional circumstances
Club Soda may disclose a user's specific personal information when it deems it necessary: to comply with the law, to cooperate with or request assistance from authorities, or to protect the interests and safeguard Club Soda’s security, or if there is a cancellation or postponement of the event for which the user has made a transaction.
Similarly, the user's personal information may be shared with a third party in the event that Club Soda's ownership or assets are transferred or in the event of bankruptcy.
Privacy concerns
Club Soda is not responsible for the use or disclosure of personal information by any third party to whom Club Soda discloses such information in accordance with this privacy policy.
